1. Operator, scope, and agreement

These Terms of Use apply to the gymbout mobile app, the gymbout website, public share pages, leaderboards, verified lift workflows, account deletion support, premium features, and related support or admin workflows.

Operator: Gymbout, H. Halbig, Stuttgarter Str. 24, 72141 Walddorfhäslach, Germany. Contact for legal and support questions: support@gymbout.com.

By creating an account, downloading the app, buying a premium feature, uploading content, entering a competition, or using a gymbout website or share page, you agree to these terms.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter these terms. If you are not eligible, you may not create an account or use gymbout.

You must provide accurate account information, keep your login secure, and tell gymbout promptly if you suspect unauthorized account access. You may not sell, transfer, rent, or share your account in a way that lets someone else compete or act as you.

  • gymbout may refuse, suspend, or terminate accounts where information appears false, incomplete, abusive, unlawful, or unsafe.
  • You are responsible for activity that happens through your account unless the activity results from gymbout's own fault or a security incident outside your reasonable control.

3. Training safety and no medical advice

gymbout is a training, tracking, competition, and community product. It does not provide medical advice, diagnosis, treatment, physiotherapy, coaching certification, or emergency services.

Strength training and fitness activities involve risk. You are responsible for choosing exercises, weights, technique, warmups, equipment, environment, and recovery that are appropriate for your condition and experience. Stop training if something feels unsafe and seek professional advice where needed.

  • Scores, rankings, workout matching, Health integration data, bodyweight suggestions, and app prompts are informational product features, not safety clearance.
  • Do not use gymbout in a way that distracts you from safe lifting, spotting, traffic, gym rules, or instructions from medical or fitness professionals.

4. Competition integrity, scores, and rankings

Leaderboards depend on honest participation. You are responsible for the accuracy of bout entries, set data, weights, repetitions, timestamps, bodyweight values, gym selections, verified lift submissions, and any supporting content you submit.

gymbout may use rules, signals, Health or tracking metadata, timing checks, score outlier checks, manual review, reports, and moderation workflows to protect fair competition. Rankings, badges, trust labels, verified lift status, and score visibility may change as reviews or recalculations happen.

  • Do not cheat, fabricate results, submit someone else's performance, manipulate timing, upload misleading media, bypass validation, exploit bugs, or coordinate abuse of rankings or reports.
  • gymbout may mark attempts as low trust, reject verified lifts, remove entries, adjust scores or rankings, reset suspicious activity, restrict features, or ban accounts when integrity issues are detected.
  • No ranking, badge, trust label, premium entitlement display, verified lift state, or public score position is guaranteed to remain unchanged.

5. Profiles, public visibility, and social features

gymbout includes public and semi-public surfaces such as profiles, leaderboards, season results, badges, activity, follower/following relationships, verified lift information, and share pages. If a product feature exposes those surfaces, other users or the public may see the related information.

Do not put private, sensitive, unlawful, misleading, or third-party information into profile text, usernames, social handles, uploaded media, reports, or other submitted content unless you have the right to share it and accept that it may be displayed as part of the service.

6. Your content and license to gymbout

You keep ownership of content you submit to gymbout, such as profile text, avatars, verified lift videos, reports, social handles, competition entries, and related metadata.

You grant gymbout a non-exclusive, worldwide, royalty-free license to host, store, copy, process, display, publish, distribute, resize, transcode, moderate, remove, and otherwise use that content as needed to operate, secure, promote, support, and improve the service and its public share surfaces.

  • You confirm that you have all rights needed to submit your content and that it does not violate law, rights of others, platform rules, or these terms.
  • gymbout may remove or restrict content without prior notice when needed for legal, safety, moderation, integrity, platform, or product reasons.

7. Prohibited conduct

You may use gymbout only for lawful training, competition, social, and support purposes. You must respect other athletes, gymbout staff, platform providers, and third-party rights.

  • Do not harass, threaten, abuse, discriminate, impersonate, dox, spam, exploit, or publish illegal or harmful content.
  • Do not scrape protected data, reverse engineer restricted systems, bypass access controls, attack the service, overload infrastructure, tamper with APIs, or interfere with security.
  • Do not evade bans, create fake accounts, abuse report or support flows, manipulate payments, infringe intellectual property, or use gymbout for unlawful commercial, surveillance, or automated activity.

8. Reports, moderation, suspension, and termination

gymbout may review reports, profiles, verified lifts, competition entries, public content, and technical signals to handle abuse, fraud, illegal content, safety issues, payment issues, account security, or competition-integrity concerns.

gymbout may warn you, remove content, reject submissions, adjust rankings, hide public surfaces, restrict premium or social features, suspend access, ban accounts, preserve evidence, or terminate use of the service where reasonably necessary.

  • You may contact support@gymbout.com if you believe a moderation or account action is mistaken.
  • Some records may be retained after suspension, deletion, or termination where needed for security, fraud prevention, legal obligations, accounting, abuse handling, or claims.

9. Premium purchases, subscriptions, and refunds

Optional premium features may be offered through Apple App Store, Google Play, and RevenueCat. The relevant store handles payment, renewal, cancellation, billing support, taxes, and refunds according to its own terms and policies.

gymbout uses RevenueCat and store information to determine premium entitlement state. Premium access can change when a purchase expires, renews, is refunded, is revoked, cannot be verified, or is otherwise changed by the store or RevenueCat.

  • Cancel subscriptions through the store account where you purchased them.
  • Unless mandatory law says otherwise, refund requests must be made through the relevant app store process.
  • gymbout may change premium features, pricing, trials, or availability for future periods, subject to store rules and mandatory consumer rights.

10. Optional integrations and platform features

Some gymbout features depend on platform permissions or third-party services, including Apple HealthKit, Android Health Connect, device location, push notifications, live activities, Firebase Analytics, Crashlytics, Google Places, Apple, Google, RevenueCat, and Supabase.

Those features are optional where the app asks for permission or consent. Their availability, accuracy, processing, and platform controls may depend on your device, operating system, store account, region, third-party service status, and permissions.

  • Health, bodyweight, workout matching, location, notification, analytics, crash reporting, and payment flows are also described in the privacy policy.
  • If you disable a permission or integration, related features may stop working or may only work with reduced functionality.

11. Account deletion and ending use

You can stop using gymbout at any time. You can delete your account in the app where available or request deletion through the account deletion support page or support@gymbout.com.

Deleting the app from your device does not automatically cancel subscriptions, delete your gymbout account, or remove public information already processed by the service. Subscriptions must be cancelled through the relevant app store.

12. Availability, changes, and beta nature of features

gymbout is provided as an evolving service. Features, exercises, scoring, leagues, rankings, verified lift workflows, premium benefits, app screens, website pages, admin tooling, and integrations may change, pause, or be discontinued.

gymbout does not guarantee uninterrupted availability, error-free operation, permanent storage of all content, compatibility with every device or region, or that every competition, ranking, notification, integration, or upload will be available at all times.

13. Intellectual property

gymbout, its design, software, source code, brand, logos, text, layouts, scoring systems, and service structure are protected by intellectual property and other laws. Except for rights expressly granted to you, gymbout and its licensors keep all rights in the service.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create competing or derivative services from gymbout except where mandatory law allows it.

14. Liability and mandatory rights

Nothing in these terms limits liability where liability cannot legally be limited, including liability for intent, gross negligence, injury to life, body, or health, mandatory product liability, or mandatory consumer rights.

For other cases, gymbout is liable only to the extent required by applicable law. To the extent legally permitted, gymbout is not liable for indirect or consequential damages, lost profits, lost data, training decisions, user-generated content, third-party services, store billing issues, or unavailable features.

15. Governing law, consumer protection, and disputes

German law applies to these terms and your use of gymbout. Mandatory consumer protection rules in your country of residence remain unaffected if they apply.

If there is a dispute, contact support@gymbout.com first so gymbout can try to resolve it informally. Mandatory rights to contact consumer protection bodies, courts, or authorities remain unaffected.

16. Changes to these terms

gymbout may update these terms when the product, legal requirements, providers, safety needs, competition rules, or business model change. The last-updated date at the top shows the current version.

If a change materially affects your rights or obligations, gymbout will use a reasonable notice method where required. Continued use after an update means the updated terms apply.
